Welcome to UpAesthetic, LLC ("Company", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the websites, web applications, APIs, and online tools operated by UpAesthetic, LLC, including UpAesthetic.com, LashMap.ai, WhatEyeColor.com, and any related software services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.

1. Software License & Access UpAesthetic, LLC grants you a personal, non-exclusive, non-transferable, revocable license to access and use our web-based software applications purely for individual styling simulation, visual reference, and informational purposes. All Services are delivered 100% online through standard web browsers; no physical software media or physical goods are sold or shipped.

2. Strict Non-Medical Disclaimer OUR SERVICES DO NOT PROVIDE MEDICAL ADVICE, CLINICAL DIAGNOSIS, OR HEALTHCARE TREATMENT. The visual simulations, iris pattern analyses, and facial landmark mappings provided by our software (including LashMap.ai and WhatEyeColor.com) are intended solely for personal styling, reference, and entertainment purposes. They must never be treated as clinical evaluations, dermatological diagnostics, or ophthalmic measurements. Always consult a qualified, licensed healthcare professional for any medical or ocular health questions.

3. Accounts & Subscriptions To access premium features or generated reports, you may be required to purchase a recurring subscription or one-time digital service. All transactions are securely processed via our third-party payment partner (Stripe). By providing your billing details, you authorize recurring charges to your payment method until cancelled. You are responsible for safeguarding your login credentials.

4. Intellectual Property All software code, visual interfaces, proprietary algorithms, website design, text, graphics, and trademarks are the exclusive intellectual property of UpAesthetic, LLC. You may not reverse-engineer, decompile, scrape, copy, or redistribute our software, models, or underlying assets without prior written consent.

5. Limitation of Liability To the maximum extent permitted by applicable law, UpAesthetic, LLC, its members, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of or inability to use our Services, or for any aesthetic decisions made based on software simulations.

6. Governing Law These Terms and any disputes arising out of or related to your use of the Services shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law provisions.
